In this brief paper, offered as a policy viewpoint, I introduce what I believe to be a novel concept for supporting individual citizen interaction with the U.S. Federal government, termed the individual social account. I explore whether and how the concept might be implemented so as to strengthen the U.S. social safety net and further citizen trust and responsibility in e-government interactions. I illustrate and develop the concept as a platform for reform and suggest and discuss design criteria, surfacing various (...) issues. Over the past 40 years, scholars and practitioners of public relations have often cast public relations workers in the role of the public relations-person-as-corporate-conscience. This work, however, maintains that this construct is so problematic that invoking it is of negligible use in addressing ethical issues that emerge during a crisis. In fact, a complex crisis, such as the Jahi McMath “brain death” case at Children’s Hospital Oakland, demonstrates the need to abandon the PRPaCC construct to better engage affected stakeholders, including (...) “outsiders” to the organization, who often determine whether an organization is facing a crisis. Through an examination of both the concept of the PRPaCC and the McMath crisis, this work makes the case for moving beyond the PRPaCC construct in favor of a more modest role for the public relations person: facilitating widespread ethical deliberation and discussion throughout an organization, potentially helping the organization alleviate concerns that contribute to crises. Increasing genetic knowledge over the last decade has enabled hundreds of genetic variants associated with inherited cardiac conditions to be identified, many of which cause increased risk of sudden cardiac death. While individually these conditions are rare, taken together they impose a significant burden. The severity of these conditions—the possibility that they might cause sudden unheralded death of a teenager or young adult—juxtaposed with uncertainty about the pathology linked with many of the genetic variants is significant in terms of professional (...) practice because, increasingly, clinicians have been encouraged to cascade out genetic testing from the proband or consultand to other family members who may be at risk of developing the same condition. This process often involves sharing human tissue samples, DNA or personal information. This paper reviews the legal and regulatory frameworks which may apply when tissue and DNA samples are collected, used and retained, both for the purpose of diagnosis and for benefiting other family members, when a suspected or definitive diagnosis of an inherited cardiovascular condition is made. Sometimes the interests of family members may conflict, and it may be difficult for practitioners to reconcile the interests of one family member with another, particularly if the balance of benefits and harms from testing is unclear. The paper then examines some of the ethical tensions which may arise in practice and concludes that all involved should be conversant with the legal and ethical frameworks that apply. (shrink)

BackgroundAlthough the number of reporting guidelines has grown rapidly, few have gone through an updating process. The STARD statement (Standards for Reporting Diagnostic Accuracy), published in 2003 to help improve the transparency and completeness of reporting of diagnostic accuracy studies, was recently updated in a systematic way. Here, we describe the steps taken and a justification for the changes made.ResultsA 4-member Project Team coordinated the updating process; a 14-member Steering Committee was regularly solicited by the Project Team when making critical (...) decisions. First, a review of the literature was performed to identify topics and items potentially relevant to the STARD updating process. After this, the 85 members of the STARD Group were invited to participate in two online surveys to identify items that needed to be modified, removed from, or added to the STARD checklist. Based on the results of the literature review process, 33 items were presented to the STARD Group in the online survey: 25 original items and 8 new items; 73 STARD Group members (86 %) completed the first survey, and 79 STARD Group members (93 %) completed the second survey.Then, an in-person consensus meeting was organized among the members of the Project Team and Steering Committee to develop a consensual draft version of STARD 2015. This version was piloted in three rounds among a total of 32 expert and non-expert users. Piloting mostly led to rewording of items. After this, the update was finalized. The updated STARD 2015 list now consists of 30 items. Compared to the previous version of STARD, three original items were each converted into two new items, four original items were incorporated into other items, and seven new items were added.ConclusionsAfter a systematic updating process, STARD 2015 provides an updated list of 30 essential items for reporting diagnostic accuracy studies. One of the most popular Asian classics for roughly two thousand years, the Vimalakirti Sutra stands out among the sacred texts of Mahayana Buddhism for its conciseness, its vivid and humorous episodes, its dramatic narratives, and its eloquent exposition of the key doctrine of emptiness or nondualism. Unlike most sutras, its central figure is not a Buddha but a wealthy townsman, who, in his mastery of doctrine and religious practice, epitomizes the ideal lay believer. For this reason, the sutra has (...) held particular significance for men and women of the laity in Buddhist countries of Asia, assuring them that they can reach levels of spiritual attainment fully comparable to those accessible to monks and nuns of the monastic order. Esteemed translator Burton Watson has rendered a beautiful English translation from the popular Chinese version produced in 406 C.E. by the Central Asian scholar-monk Kumarajiva, which is widely acknowledged to be the most felicitous of the various Chinese translations of the sutra and is the form in which it has had the greatest influence in China, Japan, and other countries of East Asia. Watson's illuminating introduction discusses the background of the sutra, its place in the development of Buddhist thought, and the profundities of its principal doctrine: emptiness. (shrink)

Increased knowledge of the gene–disease associations contributing to common cancer development raises the prospect of population stratification by genotype and other risk factors. Individual risk assessments could be used to target interventions such as screening, treatment and health education. Genotyping neonates, infants or young children as part of a systematic programme would improve coverage and uptake, and facilitate a screening package that maximises potential benefits and minimises harms including overdiagnosis. This paper explores the potential justifications and risks of genotyping children (...) for genetic variants associated with common cancer development within a personalised screening programme. It identifies the ethical and legal principles that might guide population genotyping where the predictive value of the testing is modest and associated risks might arise in the future, and considers the standards required by population screening programme validity measures . These are distinguished from the normative principles underpinning predictive genetic testing of children for adult-onset diseases—namely, to make best-interests judgements and to preserve autonomy. While the case for population-based genotyping of neonates or young children has not yet been made, the justifications for this approach are likely to become increasingly compelling. A modified evaluative and normative framework should be developed, capturing elements from individualistic and population-based approaches. This should emphasise proper communication and genuine parental consent or informed choice, while recognising the challenges associated with making unsolicited approaches to an asymptomatic group. This article seeks to explain the variable implementation of gender mainstreaming as a `policy frame' over time and across various international organisations (I.O.s). In the years since the U.N. Fourth World Women's Conference in Beijing (1995),mainstreaming has been endorsed and adopted by a wide range of international organisations, and we compare the adoption and implementation of mainstreaming in four specific I.O.s: the World Bank, the United Nations Development Programme, the Organisation for Security and Cooperation in Europe, and the European Union. The rhetorical acceptance of mainstreaming by various international organisations, however, obscures considerable variation in both the timing and the nature of the mainstreaming process within and among organisations. This variation, in turn, can be explained in terms of the categories of political opportunity, mobilising structures and strategic framing, which have been put forward by social movement theorists. There is much to admire in John Pittard’s recent book on the epistemology of disagreement. But here we develop one concern about the role that rational insight plays in his project. Pittard develops and defends a view on which a party to peer disagreement can show substantial partiality to his own view, so long as he enjoys even moderate rational insight into the truth of his view or the cogency of his reasoning for his view. Pittard argues that this may (...) happen in ordinary cases of religious disagreement—cases in which it’s a live skeptical possibility that one is misdescribing his insight, or not having insight at all—and therefore one need not be strongly conciliatory even in the face of peer disagreement. Yet Pittard agrees that one should be strongly conciliatory in cases of disagreement involving, e.g., visual perception and dim rational insight, since the sort of fallible, corrigible evidence involved in such cases may be counterbalanced by symmetrical evidence on the part of one’s disagreeing peer. We worry that there’s an inconsistency here. If it’s unreasonable to show partiality to one’s visual experience (or dim rational insight) in cases like “Horse Race” and “Restaurant Check,” it’s likewise unreasonable to show partiality in religious disagreements to one’s moderate rational insight, fallible and corrigible as it is. This paper opens with first‐hand accounts of critical care medical interventions in which detainees, in the custody of U.S. Immigration and Customs Enforcement (ICE), are brought to the emergency department for treatment. This case dramatizes the extent to which the provision of ethical and acceptable nursing care is jeopardized by federal law enforcement paradigms. Drawing on the scholarship of Michel Foucault and Giorgio Agamben, this paper offers a theoretical account of the power dynamics that inform the health care of patients (...) who find themselves caught in the custodial scaffolding of a vast immigration and detention apparatus. It offers an analysis of the display of sovereign and biopolitical power over the lives (and deaths) of detainees (Foucault), as well as the ways these individuals are reduced to “bare life” under the political pretext of an emergency or “state of exception” (Agamben). Our purpose here is both theoretical and practical: to better understand the often hidden agency or impersonal “will” exercised by the immigrant detention system, but also to equip clinicians in these and cognate facilities (e.g., prisons) with the critical tools by which they might better navigate incommensurable paradigms (i.e., care vs. custody) in order to deliver the best care while upholding their ethical duties as a care provider. This is all the more pressing because hospitals are not sanctuaries and given the incursion of federal law enforcement agents, nurses may find themselves conscripted as de facto agents of the state. Few studies have examined the influence of the food environment on obesity rates among very young, low-income consumers. This research contributes to this growing literature by examining the relationship between modifications to the retail environment and obesity rates for low-income, preschool-aged children. Based on data combined from various secondary sources, this study finds that changes in the retail environment are significantly related to obesity rates. More specifically, the authors find a positive relationship between the number of convenience stores in the (...) retail environment and obesity rates among low-income, preschool-aged children. Results also show that the percent change in grocery stores and supercenters and club stores in the retail environment is negatively related to the obesity rates of low-income, preschool-aged children [i.e., as grocery stores and supercenters/club stores increase, obesity decreases ].Further, the percent change in supercenters and club stores mediates the positive relationship between participation in the Supplemental Nutrition Assistance Program and obesity rates. Alterations to cognitive function are often reported with depression and anxiety symptoms, yet few studies have examined the same associations with mental well-being. This study examined the association between mental well-being, depression and anxiety symptoms and cognitive function in 1502 healthy adult monozygotic and dizygotic twins, and the shared/unique contribution of genetic and environmental variance. Using linear mixed models, mental well-being was positively associated with sustained attention, inhibition, cognitive flexibility, motor coordination and working memory, whereas depression and anxiety symptoms were (...) associated with poorer sustained attention, inhibition, cognitive flexibility and executive function. Bivariate twin modelling showed well-being shared a small environmental correlation with motor coordination and a small genetic correlation with working memory. Trivariate twin modelling showed well-being shared a small genetic correlation with inhibition, whereas depression and anxiety symptoms shared a small environmental correlation with inhibition. The remaining variance was mostly driven by unique G and/or E variance. Overall, well-being and depression and anxiety symptoms show both independent and shared relationships with cognitive functions but this is largely attributable to unique G or E variance and small shared G/E variance between pairs of variables. Although a number of authors have used diagrams extensively in their studies of Navya-Nyāya, they have done so to explain and illustrate concepts, not with the goal of reasoning with the diagrams themselves. Adherents of diagrammatic reasoning have made claims for its potential by pointing to key structural correspondences between diagrams and logical concepts, arguably lacking in sentential representations, and describing these relations using concepts such as “well matchedness” and “iconicity”. A canonical example of this iconicity is the use of (...) Euler diagrams to depict categorical syllogisms. Since the meaning of expressions in Indian logic differs in so many important ways from logic in the Western tradition, the use or adaptation of diagrams developed in the latter would seem to preclude iconicity. Thus, the development of diagrams which reflect the nature of inference in Navya-Nyāya, which centres on the anumāna inference schema, is motivated. In this paper we extend Ganeri’s method of depicting the Vaiśeṣika ontology with graphs to include syntax intended to expose the nature of anumāna. The diagrams are given a formal basis: i.e. abstract syntax, inference rules defined abstractly and a graph-theoretic semantics. These are the first formalised logical diagrams that aim to reflect the nature of the anumāna inference. This paper lays the way for further work in extending the formalism to cover more of Navya-Nyāya, and in exploring a dialogue between properties of the formalism and of Navya-Nyāya. (shrink)

Recent neuroimaging studies of language processing are examining the neural substrate of phonology because of its critical role in mapping sound information onto higher levels of language processing (e.g., words) as well as providing codes in which verbal information can be temporarily stored in working memory. However, the precise role of the inferior frontal cortex in spoken and written phonological tasks has remained elusive. Although lesion studies have indicated the presence of selective deficits in phonological processing, the location of lesions (...) underlying these impairments has not revealed a consistent pattern. Despite efforts to refine methods and tasks, functional neuroimaging studies have also revealed variability in activation patterns. Reanalysis of evidence from these neuroimaging studies suggests that there are functional subregions within the inferior frontal gyrus that correspond to specific components of phonological processing (e.g., orthographic to phonological conversion in reading, and segmentation in speech). In a 1985 article entitled “The Art of Glaukos,” Diskin Clay suggested that the enigmatic passage at the beginning of the geological myth in Phaedoreferred toRepublic10, where the soul is likened to the sea-creature Glaucus whose true nature, like the soul’s, is obscured by the distortions imposed by underwater life. Starting with a defense of Clay’s ingenious suggestion, my purpose is to compare Phaedoto Glaucus, with its true nature obscured by traditional assumptions about the order in which Plato composed his (...) dialogues, and thus how they should be read. At least part of the reason that Clay’s thesis has not been embraced is because it clashes with the dogma that Phaedocannot refer back to Republic; I want to challenge that dogma. Borrowing from Catherine Zuckert the notion that, since Phaedocomes at the end of Socrates’ story, it can usefully be read as the culmination of the Platonic dialogues, I will show how a “late” Phaedo—i.e., a reading of the dialogue that is open to the possibility that it refers to more than one dialogue generally considered to be later than it with respect to composition—recovers its true nature, presently encrusted with the oysters and seaweed of an outdated developmentalism that has obscured this culminating masterpiece of Plato’s dramatic and philosophical art. Grelling's Paradox is the paradox which results from considering whether heterologicality, the word-property which a designator has when and only when the designator does not bear the word-property it designates, is had by 'heterologicality'. Although there has been some philosophical debate over its solution, Grelling's Paradox is nearly uniformly treated as a variant of either the Liar Paradox or Russell's Paradox, a paradox which does not present any philosophical challenges not already presented by the two better known paradoxes. The aims (...) of this paper are, first, to offer a precise formulation of Grelling's Paradox which is clearly distinguished from both the Liar Paradox and Russell's Paradox; second, to offer a solution to Grelling's Paradox which both resolves the paradoxical reasoning and accounts for unproblematic predications of heterologicality; and, third, to argue that there are two lessons to be drawn from Grelling's Paradox which have not yet been drawn from the Liar or Russell's Paradox. The first lesson is that it is possible for the semantic content of a predicate to be sensitive to the semantic context; i.e., it is possible for a predicate to be an indexical expression. The second lesson is that the semantic content of an indexical predicate, though unproblematic for many cases, can nevertheless be problematic in some cases. In Section 1, Grelling's Paradox is presented informally. After making some refinements, Grelling's Paradox is then presented formally. In Section 2, the formal version of Grelling's Paradox is evaluated, and several previously proposed solutions are discussed and argued to be inadequate. In Section 3, it is argued that the heterologicality predicate is an indexical expression. A semantics for the heterologicality predicate is given, and it is shown how this semantics accounts for the unproblematic predications of heterologicality, as well as the problematic cases, and therefore constitutes a satisfactory and complete solution to Grelling's Paradox. Objections to this solution are addressed in Section 4. The conclusions of this paper are summarized in Section 5. (shrink)

Sentencing practices in cases of domestic homicide have been the object of critical scrutiny on previous occasions across a number of jurisdictions. It has been suggested by some that these practices reveal judges to be taking a more lenient approach to women who kill their violent male partners than to men who kill allegedly unfaithful female partners. This note evaluates claims of gender bias in sentencing practices in UK cases of domestic homicide following the Court of Appeal sentencing decision in (...) R. v. Suratan, R. v.Humes and R.v. Wilkinson [2002]E.W.C.A. 2982 concerning three men who killed their female partners. It will argue that in the wake of this decision current proposals to review both the substantive law of provocation and sentencing practices are to be welcomed. (shrink)

Much recent philosophical interest in Saint Paul focuses on his contemporary significance as a radical political thinker, following Jacob Taubes' influential late work, The Political Theology of Paul. Assessments of Paul's writing in this context (e.g. by Agamben, Badiou, Milbank) highlight the various ways in which he uses fictionalizing, for example in setting up the tension between the present (...) world and a messianic future, in the role he assigns to faith, and in the importance he assigns to the counter-factuality of resurrection. Yet the common thread of fictionalizing running through these themes has not been explicitly discussed. Meanwhile, the supposed `religious turn' in Dick's late writing has often been taken to have less political significance than his earlier science fiction. Considering Paul alongside Philip K. Dick, this article will attempt to bring out this central role of fictionalizing in the religious experiences of both. Like Paul, Dick experienced a visionary encounter with a God-like entity that shaped his interests and writing for the remainder of his life, and developed his own soteriology in response to what he perceived as the continued existence of (the Roman) Empire in modernity. Bringing out the mutual complementarity of Dick and Paul is facilitated by a framework derived from Henri Bergson's Two Sources of Religion, which theorizes the relation between mechanization as a human tendency characterizing both imperialism and industrialization, and fabulation as a human faculty for using fiction for the jointly immanent-transcendent purposes of survival/salvation. In this context, the diverse modes of fictionalizing employed by both Dick and Paul, including their unconsciously produced visions, may be understood as part of an ongoing, continually renewed strategy of revolutionary transformation of both self and world. A century after its publication, G.E. Moore''sPrincipia Ethica stands as one of theclassic statements of anti-naturalism inethics. My plan for doing so beginsby presenting the standard interpretation ofthe argument and then showing that there isan alternative to that interpretation. Thealternative is not developed at any length byMoore and stands in need of some elaboration. Continued confinement of those most vulnerable to COVID-19—e.g., the elderly, those with chronic diseases and other risk factors—is presented as an uncontroversial measure when planning exit strategies from lockdown measures. Policies for deconfinement assume that these persons will remain confined even when others will not. The BCI-facilitated PPVT-4 uses items identical to the unmodified PPVT-4, but each quadrant forced-choice item (...) is presented on a computer screen for use with the BCI.ResultsMeasurement agreement between instruments was excellent, including an intra-class correlation coefficient of 0.98, and Bland-Altman plots and tests indicating adequate limits of agreement and no systematic test version bias. The mean standard score difference between test versions was 2.0 points.ConclusionThese results demonstrate that BCI-facilitated quadrant forced-choice vocabulary testing has the potential to measure aspects of language without requiring any overt physical or communicative response. Thus, it may be possible to identify the language capabilities and needs of many individuals who have not had access to standardized clinical and research instruments. (shrink)
